Promotion Terms and Conditions

Promotions are an important part of growing the community of Plans organizers, so we’d love to start by first thanking you for your help in making Plans so great!
The Plans Collective LLC promotion (the "Promotion") offers Plans Users the opportunity to receive a Prize by inviting their friends to an event. To participate in the Program, Plans Users must agree to the following Terms and Conditions ("Terms"). We reserve the right to disqualify any Plans User from the Program at any time at our sole discretion for any violation of these Terms. Violations of these Terms may also result in the forfeiture of the Prize previously earned through the Program.
Gift Card Prizes
We award a Prize to the event organizer (Plans User) with the amount listed in the promotion page after all of the following "Qualifying Conditions" are satisfied: (1) the organizer (Plans User) must only submit 1 event form; (2) the organizer (Plans user) must not have previously registered (under any name or alias); (3) the event location of the event that the organizer (Plans User) creates must be within the US; (4) the event created by the organizer (Plans User) must be created and end before February 28, 2022 at 11:59PM PST; (5) at least 20 of the 25 required guests invited by the organizer (Plans User) must be new Plans Users (created an account after event creation); (6) at leasts 15 of the 25 required guests invited by the organizer (Plans User) must go live at the event (arrive at event location during scheduled event hours); (7) all information filled out in the promotion form by the event organizer (Plans User) must be accurate and complete; (8) the event organizer (Plans user) and guests must all be at least 18 years old. Each event organizer (Plans User) who completes all Qualifying Conditions is considered a "Qualified Organizer".
Thirty (30) people (Plans users) will win a prize with approximate retail value of $50 USD each (each a “Prize Winner”). Approximate Retail Value (“ARV”) of all Prizes: US$1,500.00. The Prize Winners will be the first 30 qualified entries received.
Each event organizer (Plans User) who is considered a "Qualified Organizer" will be notified via email provided in the form with next steps for Prize delivery. Prize delivery timeframe and requirements are subject to change at any time in Plan's sole discretion. If any "Qualified Organizer" or "Winner" communication is rejected or returned as undeliverable, if a potential Winner cannot be reached after a reasonable attempt has been made by Plans Collective LLC (as determined by Plans Collective LLC in its sole discretion), if a Winner cannot attend or participate in any portion of the applicable Prize, or if the potential Winner fails to respond to a Winner email and/or to complete the Entry within the time periods set forth herein, the prize will be forfeited in Plans Collective LLC's sole discretion and an alternate winner may be selected (time permitting) based on the original method of winner selection in Plans Collective's sole discretion. Plans Collective LLC reserves the right to modify the notification procedures in connection with the selection of any alternate potential Winner. If legitimately claimed in compliance with these Official Rules, the Prize will be awarded. To claim a Prize, a Winner must follow the directions in his or her Winner email.
All Prize details not specified in these Official Rules will be determined by Plans Collective LLC. Plans Collective LLC is not responsible for and will not replace any lost or stolen Prize or any Prize that is undeliverable or does not reach the Prize Winner because of incorrect or changed contact information. If the Prize Winner does not accept or use the entire Prize, the unaccepted or unused part of the Prize will be forfeited and Plans Collective LLC will have no further obligation with respect to that Prize or portion of the Prize. Plans Collective LLC is not responsible for any inability of the Prize Winner to accept or use any Prize (or portion thereof) for any reason. No transfers or prize substitutions will be made, except at Plans Collective’s sole discretion. No more than the stated prizes will be awarded. Participants waive the right to assert as a cost of winning any Prize, any and all costs of verification and redemption or travel to claim or use a Prize and any liability and publicity which might arise from claiming, seeking to claim, or using a Prize. Notice of any changes will be posted in the promotion page at https://www.plansapp.io/promo.
Restrictions
Event invitations should only be made to your personal connections. You may notify your friends and acquaintances about this Program through your personal social media accounts, but posting public notices or your unique link on jobs boards, blogs, websites, search engines, or other platforms accessible to the general public are not allowed. For your own safety, please do not post your Registered Phone Number or any other personal data on any public websites or in any other public areas. Entrants may not submit an Entry on behalf of someone else.
Event organizers may not invite guests using multiple or fake email addresses; accounts with fictitious identities; or any system, macro, script, bot or other device or artifice to participate in the Program.
Bulk email distribution; multiple referral messages sent to the same person; or any other promotion in a manner that would constitute or appear to constitute unsolicited commercial messages or “spam” in Plans Collective’s sole discretion is expressly prohibited and is grounds for immediate termination of a Plan user's account, exclusion from the Program.
Plans Collective LLC may delay a Prize for the purposes of investigation. We reserve the right to revoke or refuse to issue a Prize for any reason (e.g. an event organizer (Plans User) whom we suspect to be a previously registered Plans User).
Termination and Changes
Plans Collective LLC reserves the right to close the account(s) of any Plans User and to cancel a gift card prize if we determine in our sole discretion that the referring and/or referred Plans User has tampered with the Program or used or attempted to use the Program in a fraudulent, abusive, unethical, unsportsmanlike or otherwise suspicious manner or in violation of these Terms or any applicable law or regulation.
Additionally, Plans Collective LLC reserves the right to cancel the Program or change these Terms and the conditions and methods through which gift card prizes may be earned at any time and for any reason in its sole discretion.
Liability Release
Except where prohibited, Plans Users agree that by participating in the Program, they agree: (1) to be bound by these Terms the decisions of Plans Collective LLC, and privacy policies; to release and hold harmless from any and all claims, demands, damages, losses, liabilities, costs or expenses caused by, arising out of, in connection with, or related to their participation in the Program (including, without limitation, any property loss, damage, personal injury or death caused to any person(s) and/or the awarding, receipt and/or use or misuse of the Program or any Prize).
Except where prohibited by law, Plans Collective LLC shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind resulting from acceptance, possession or use of a Prize, or from participation in the Program; or (v) any printing, typographical, administrative or technological errors in any websites or materials associated with the Program. Plans Collective LLC disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Program, and reserve the right, in their sole discretion, to cancel, modify or suspend the Program should a virus, bug, computer problem, unauthorized intervention or other causes beyond Plans Collective LLC control, corrupt the administration, security or proper play of the Program.
Except where prohibited, Plans Collective LLC shall not be liable to any Plans Users for failure to supply any prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, tornado, tsunami, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other similar or dissimilar cause beyond any of the Plans Collective's control.
As a condition of entering the Program, and unless prohibited by law, Plans Users agree that under no circumstances will Plans Users be entitled to any awards for any losses or damages, and Plans Users hereby waive all rights to claim punitive, incidental, consequential and any other damages, and waives any and all rights to have damages multiplied or otherwise increased. A waiver of rights may not apply to you in your jurisdiction of residence. Additional rights may be available to you.
Plans Collective LLC reserves the right to cancel or suspend this Program should it determine, in its sole discretion, that the administration, security or fairness of this Program has been compromised in any way.
Applicable Law
Except where prohibited, disputes, claims and causes of action arising out of or related to this Program or any prize awarded shall be resolved under the laws of the United States, and except where prohibited, California law (without reference to its conflicts of laws principles), and participant agrees to submit any dispute to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California. BY PARTICIPATING IN THE PROGRAM,, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION THAT CANNOT BE RESOLVED BETWEEN ENTRANT AND ANY RELEASEE ARISING OUT OF OR CONNECTED WITH THE PROGRAM, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED, (IF ANY), NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.
Privacy
Participation in the Program may require a Referred Customer and/or a Referrer to submit personal information about themselves. The personal information will be collected, processed and used in accordance with Plan Collective's Privacy Policy which can be found at https://www.plansapp.io/privacy-policy. In addition, personal information may be used by Company on Company's behalf, to contact Users with regards to participation in the Program and to receive communications from Plans Collective or third party administrators of the Program.
